The Product Liability Act in Indiana governs tort claims related to product liability. It encompasses actions brought by users or consumers against manufacturers or sellers for physical harm caused by a product, regardless of liability theory. Products can be considered defective if they pose unreasonable danger to users or consumers and are sold without substantial alterations. The Act also covers failure to warn, supplier liability, and rebuttable presumptions regarding product safety. Affirmative defenses include comparative fault, statutes of limitations, defenses related to knowledge of defects, misuse, modification or alteration of products, unavoidably unsafe products, and compliance with standards. Damages under the Act include physical harm such as bodily injury or death, with limitations on punitive damages.
